Welcome to Zync! These Terms of Service ("Terms") govern your use of the Zync mobile application ("App") provided by XYZABC Technologies ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Zync, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Zync is a proximity-based social discovery application that allows users to:

• Create and share personal profiles via Bluetooth Low Energy (BLE)
• Discover profiles of nearby users
• Search for users globally based on interests
• Connect with others through shared social media links

3. Account Registration

3.1 Google Sign-In

To use Zync, you must sign in using your Google account. By doing so, you authorize us to access certain information from your Google account as described in our Privacy Policy.

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. User Conduct

4.1 Acceptable Use

You agree to use Zync only for lawful purposes. You must NOT:

• Impersonate any person or entity
• Post false, misleading, or fraudulent content
• Harass, bully, or threaten other users
• Share content that is illegal, offensive, or inappropriate
• Attempt to gain unauthorized access to other accounts
• Use the App for commercial solicitation without permission
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App

4.2 Profile Content

You are solely responsible for the content you share in your profile. By broadcasting your profile via BLE or making it available through global search, you consent to other users viewing this information.

5. Premium Subscription

5.1 Premium Features

Zync offers premium subscriptions that provide additional features including:

• Ad-free experience
• Unlimited global searches
• Advanced filtering options
• Priority notifications
• Premium profile badge

5.2 Billing

Premium subscriptions are billed through Google Play. By subscribing, you agree to Google Play's terms of service. Subscription fees are charged at the beginning of each billing period.

5.3 Cancellation

You may cancel your subscription at any time through Google Play Store. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5.4 Price Changes

We reserve the right to modify subscription prices. You will be notified of any price changes in advance, and the new price will apply from your next billing cycle.

6. Bluetooth & Location Permissions

Zync requires Bluetooth and location permissions to function properly. By granting these permissions, you understand that:

• Your profile may be visible to nearby Zync users when broadcasting is enabled
• Location permission is required by Android for BLE scanning (we do not track your location)
• You can control broadcasting and scanning settings within the App

7. Intellectual Property

7.1 Our Rights

The App, including its design, features, content, and trademarks, is owned by XYZABC Technologies and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Your Content

You retain ownership of the content you create and share through Zync. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with providing the service.

8. Disclaimers

We are not responsible for:

• Interactions or disputes between users
• Content posted by other users
• Any harm resulting from meetings arranged through the App
• Loss of data or service interruptions

9. Limitation of Liability

To the maximum extent permitted by law, XYZABC Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for premium subscriptions in the past 12 months.

10. Indemnification

You agree to indemnify and hold harmless XYZABC Technologies from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Account Termination

11.1 By You

You may delete your account at any time through the App settings. Upon deletion, your data will be permanently removed as described in our Privacy Policy.

11.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any reason at our discretion. We will attempt to notify you before termination unless immediate action is required.

12. Modifications to Terms

We may update these Terms from time to time. Material changes will be notified through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any legal proceedings, you agree to attempt to resolve any disputes informally by contacting us at xyzabc.developer@gmail.com. We will attempt to resolve the dispute within 30 days of receiving your complaint.

13.2 Arbitration

If informal resolution is unsuccessful, any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall take place in India and shall be conducted in English.

14. Governing Law

These Terms are governed by the laws of India. Subject to the arbitration clause above, any disputes shall be resolved in the courts of competent jurisdiction in India.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
